These Terms of Service govern your use of Syte Studio’s services. By purchasing or using our services, you agree to these terms.

1. Services Provided

Syte Studio provides one time, project based Shopify store design and setup services.

Our services may include Shopify store configuration, theme installation and customization, product listings, product descriptions, image alt text, SEO optimization, navigation, collections, essential pages, store policies, mobile optimization, and other work agreed upon as part of the project.

Each project is completed based on the agreed scope, number of products, and information provided by the client.

2. Pricing and Payment

All prices are listed on our website and may change at any time. The price confirmed at the time of purchase will be honored.

Full payment is required before work begins.

Payments are processed securely through our payment provider.

Any work requested outside the original project scope may require an additional fee. Additional work will be discussed and approved before it begins.

3. Delivery

Shopify store projects are typically completed within 5 business days after all required information and Shopify access have been received.

Delivery timelines are estimates and may vary depending on the size and requirements of the project.

If a client is unresponsive for 7 or more business days after required information has been requested, Syte Studio may pause the project and extend the delivery timeline accordingly.

Syte Studio is not responsible for delays caused by missing information, incomplete materials, lack of access, or delayed communication from the client.

4. Client Responsibilities

Clients agree to:

Provide accurate product information, images, pricing, branding materials, and other information needed for the project
Provide the necessary access to their Shopify store
Respond to project related communications in a timely manner
Confirm that they have the legal right to use all content, images, trademarks, and materials provided to Syte Studio
Maintain the security of their Shopify account and login credentials

Syte Studio is not responsible for unauthorized access, data loss, or other issues resulting from compromised client accounts or credentials.

5. Shopify Store Access

Clients may provide Syte Studio with collaborator access to their Shopify store for the purpose of completing the project.

Syte Studio will use this access only to perform the agreed services.

The client remains the owner of their Shopify store and is responsible for managing account security, billing, subscriptions, and access after the project is completed.

6. Intellectual Property

Upon full payment and project completion, the client owns the completed deliverables created specifically for their project, including product listings, product descriptions, store customizations, and other agreed project content.

Syte Studio retains ownership of its proprietary processes, templates, systems, and methodologies used to provide the services.

The client receives the right to use any such materials as part of their completed Shopify store.

Unless the client requests otherwise in writing, Syte Studio may use anonymized or generalized examples of completed work for portfolio or marketing purposes.

7. Client Provided Materials

The client is solely responsible for ensuring they have the necessary rights to all content, images, logos, trademarks, product information, and other materials provided to Syte Studio.

Syte Studio is not responsible for intellectual property claims arising from materials provided by the client.

8. Revisions and Scope

Each project includes the work outlined at the time of purchase.

Reasonable revisions related to the agreed scope may be made during the project.

Requests that fall outside the original scope may be considered additional work and may require an additional fee.

Syte Studio does not provide unlimited revisions unless specifically agreed to in writing before the project begins.

9. Refunds and Cancellations

A full refund is available only if an order is cancelled before work has begun.

Once work has started, all sales are final and no full or partial refunds will be issued.

Work begins when Syte Studio starts any part of the project, including store configuration, design, product setup, research, planning, content preparation, SEO optimization, or other project related work.

10. No Guarantee of Business Results

Syte Studio will make reasonable efforts to provide professional Shopify store design and setup services.

However, we do not guarantee sales, revenue, traffic, search rankings, conversions, or any other specific business result.

Business results depend on factors outside our control, including product demand, pricing, competition, market conditions, customer behavior, advertising, and third party platforms.

11. Third Party Platforms

Syte Studio uses Shopify and other third party services when necessary to provide our services.

We are not responsible for changes, outages, restrictions, policy changes, account actions, technical issues, or other actions taken by Shopify or other third party providers.

Platform fees, hosting costs, subscriptions, transaction fees, and other third party charges are the responsibility of the client and are billed directly by the respective providers.

12. Chargebacks and Payment Disputes

If you have a concern about your purchase or project, please contact Syte Studio first so we have an opportunity to resolve the issue.

Syte Studio reserves the right to respond to payment disputes or chargebacks with relevant documentation, including payment records, project records, communications, and evidence of work completed.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Syte Studio’s total liability for any claim related to our services will not exceed the amount paid by the client for the specific service giving rise to the claim.

Syte Studio will not be responsible for indirect, incidental, special, or consequential damages, including lost profits, lost revenue, lost data, or lost business opportunities, to the extent permitted by law.

14. Dispute Resolution

In the event of a dispute arising from these Terms or our services, both parties agree to first attempt to resolve the matter through good faith communication.

If a resolution cannot be reached, either party may pursue available legal remedies in accordance with applicable law.

Nothing in this section prevents either party from seeking appropriate injunctive or equitable relief where necessary.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

16. Changes to These Terms

Syte Studio reserves the right to update these Terms from time to time.

Any changes will be posted on this page with an updated effective date.
